Terms of Service

1. Acceptance of Terms

Welcome to Muderchemo Tourism. These Terms of Service ("Terms") govern your use of our website muderchemo.com and our tourism services (collectively, the "Services"). By accessing our website, booking our services, or participating in our activities, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our Services. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting on our website.

2. About Our Services

Muderchemo Tourism is a Northern Ontario-based company offering wilderness tourism experiences, including but not limited to:

  • Guided fishing expeditions
  • Wilderness camping experiences
  • Nature hiking and wildlife viewing
  • Winter activities including ice fishing and snowshoeing
  • Aurora viewing tours
  • Photography workshops and expeditions

All activities are conducted in the wilderness areas of Northern Ontario and involve inherent risks associated with outdoor activities.

3. Booking and Payment Terms

3.1 Booking Process

Bookings can be made through our website contact form, by phone, or by email. A booking is not confirmed until you receive written confirmation from us and any required deposit has been received.

3.2 Payment Terms

  • A deposit of 50% of the total cost is required to confirm your booking
  • Full payment is due 30 days before your arrival date
  • We accept cash, credit cards, and electronic transfers
  • All prices are in Canadian dollars (CAD) and include applicable taxes unless otherwise stated
  • Prices are subject to change without notice until booking is confirmed

3.3 Group Bookings

Special terms may apply to group bookings of 6 or more people. Contact us directly for group pricing and payment schedules.

4. Cancellation and Refund Policy

4.1 Cancellation by Client

  • More than 60 days before arrival: Full refund minus 10% administrative fee
  • 30-60 days before arrival: 50% refund
  • 15-29 days before arrival: 25% refund
  • Less than 15 days before arrival: No refund

4.2 Cancellation by Muderchemo Tourism

We reserve the right to cancel any booking due to:

  • Severe weather conditions or safety concerns
  • Insufficient bookings for a particular trip
  • Force majeure events (see Section 11)
  • Government restrictions or regulations

If we cancel your booking, you will receive a full refund or the option to reschedule to a future date.

4.3 Weather-Related Modifications

Outdoor activities are weather-dependent. We may modify itineraries due to weather conditions. Such modifications do not constitute grounds for cancellation or refund, though we will do our best to provide alternative activities of equal value.

5. Health and Safety Requirements

5.1 Physical Fitness

Participants must be in reasonable physical condition appropriate for their chosen activities. Some activities require moderate to strenuous physical exertion. If you have any health concerns or limitations, please discuss them with us before booking.

5.2 Medical Information

You must disclose any medical conditions, allergies, or medications that could affect your safety or the safety of others during activities. Failure to disclose relevant medical information may result in exclusion from activities without refund.

5.3 Age Restrictions

  • Children under 12 must be accompanied by a parent or guardian
  • Some activities have minimum age requirements for safety reasons
  • Participants under 18 require written parental consent

5.4 Safety Equipment

We provide necessary safety equipment including life jackets, first aid supplies, and emergency communication devices. Participants are required to use safety equipment as directed by guides.

6. Participant Responsibilities

6.1 Following Instructions

Participants must follow all instructions from guides and staff. Failure to follow safety instructions or behaving in a manner that endangers yourself or others may result in immediate removal from activities without refund.

6.2 Equipment and Property

Participants are responsible for any damage to equipment or property caused by negligence or misuse. Replacement costs will be charged accordingly.

6.3 Environmental Responsibility

All participants must follow Leave No Trace principles and respect wildlife and natural environments. Violations of environmental guidelines may result in immediate termination of services.

6.4 Alcohol and Substances

Consumption of alcohol or illegal substances during activities is strictly prohibited. Participants found to be under the influence will be immediately removed from activities without refund.

7. Liability and Risk Acknowledgment

7.1 Assumption of Risk

You acknowledge that outdoor activities in wilderness settings involve inherent risks, including but not limited to:

  • Injuries from outdoor activities
  • Weather-related hazards
  • Wildlife encounters
  • Equipment failure
  • Getting lost or separated from the group
  • Remote location medical emergencies

By participating in our activities, you voluntarily assume these risks.

7.2 Limitation of Liability

To the fullest extent permitted by law, Muderchemo Tourism, its owners, employees, guides, and agents shall not be liable for any injury, death, loss, or damage arising from participation in our activities, except where such liability cannot be excluded by law.

7.3 Waiver and Release

All participants must sign a comprehensive liability waiver and release form before participating in any activities. This document is in addition to these Terms and provides important legal protections.

8. Photography and Media

By participating in our activities, you consent to being photographed or filmed for promotional purposes. These images may be used in our marketing materials, website, and social media without additional compensation. If you prefer not to be included in promotional materials, please inform us in writing before your trip.

9. Accommodations and Meals

9.1 Accommodation Standards

We provide wilderness accommodations that may include rustic cabins, tents, or other outdoor lodging. These accommodations are designed for the wilderness experience and may not include modern amenities found in hotels.

9.2 Meals and Dietary Requirements

Meals are provided as specified in your booking confirmation. Please inform us of any dietary restrictions or allergies at least 14 days before arrival. We will make reasonable efforts to accommodate dietary needs, but cannot guarantee all requests can be met in remote locations.

10. Transportation

Transportation to and from the wilderness areas is included in most packages as specified. We are not responsible for your transportation to our departure points or for any delays in your travel arrangements. Travel insurance is strongly recommended.

11. Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms if such failure results from events beyond our reasonable control, including but not limited to:

  • Natural disasters, severe weather, or acts of God
  • Government actions, regulations, or travel restrictions
  • Labor disputes or strikes
  • War, terrorism, or civil unrest
  • Pandemic or public health emergencies
  • Equipment failure or technical problems beyond our control

12. Privacy and Personal Information

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we handle your personal information.

13. Intellectual Property

All content on our website, including text, images, logos, and design elements, is the property of Muderchemo Tourism or used with permission. You may not reproduce, distribute, or use our content without written permission.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms or your use of our Services shall be resolved in the courts of Ontario, Canada.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.

16. Entire Agreement

These Terms, together with our Privacy Policy and any signed liability waivers, constitute the entire agreement between you and Muderchemo Tourism regarding your use of our Services. These Terms supersede all prior communications, agreements, and understandings.

17. Emergency Procedures

In case of emergency during your trip, our guides are trained in first aid and emergency response procedures. We maintain emergency communication equipment and have established protocols for medical evacuations when necessary. Emergency costs may be charged to participants and should be covered by travel insurance.
